Supreme Court set to deliver judgment on Alcohol Endorsement Restrictions

The Supreme Court is scheduled to deliver its judgment on April 10 in a case challenging the directive issued by the Food and Drug Authority (FDA) that prohibits well-known personalities, including musicians, from endorsing alcoholic beverages.


This directive, established in 2016, outlines guidelines stating that no renowned figure or professional should be featured in alcoholic beverage advertisements. Mark Darlington Osae, the manager for musicians Reggie N Bollie and the plaintiff in this case, contends that the directive is discriminatory and unconstitutional. He is seeking an injunction against the FDA, arguing that the directive violates articles 17(1) and 17(2) of the constitution.


Osae's case, which was initiated in November 2022, is approaching its conclusion as the involved parties have submitted their memoranda of issues for consideration by the Supreme Court. 


The plaintiff asserts that the court should interpret articles 17(1) and 17(2) to declare the FDA's directive as discriminatory. The court has set April 10 for the judgment, signifying a crucial moment in the legal challenge against the FDA's advertising guidelines for alcoholic beverages featuring well-known personalities.
