The recent lawsuit filed by private legal practitioner Kwame Aning Fosu-Gyeabour against the Chief Justice, the General Legal Council (GLC), and the Judicial Secretary has sparked significant interest within the legal community. The lawsuit, filed on February 22, 2024, alleges that the defendants acted unlawfully in issuing a circular to all courts instructing them not to grant audience to Mr. Fosu-Gyeabour.

In the lawsuit, Mr. Fosu-Gyeabour contends that the circular issued by the defendants on February 16, 2024, is false, unlawful, illegal, irregular, and in breach of natural justice. Furthermore, he asserts that the circular is unconstitutional and therefore should be deemed null and void.

Of particular concern to Mr. Fosu-Gyeabour is the impact of the circular on his ability to practice law. With his license purportedly not renewed for the year 2024, he is seeking an order to set aside the circular and a perpetual injunction restraining the defendants from preventing him from practicing law without due process.

The circular, issued by the GLC through the Judicial Secretary, conveyed the message that Mr. Fosu-Gyeabour's license had not been renewed for 2024 and therefore instructed all courts not to grant him audience until further notice from the GLC. Additionally, it stated that any order issued on his application would be void.

This legal dispute raises important questions about due process, constitutional rights, and the authority of regulatory bodies in the legal profession. It underscores the need for careful consideration of the balance between regulatory oversight and individual rights within the legal community.

As this case unfolds, it will be important to closely monitor the legal arguments presented by both parties and the potential implications for legal practitioners and regulatory bodies. The outcome of this lawsuit may have far-reaching consequences for the practice of law and the regulation of legal professionals in our jurisdiction.

We will continue to follow this case closely and provide updates as it progresses through the legal system.
