Dapaah’s stolen cash: Court strikes out Prosecution’s request for restriction on property disposal

The recent developments in the case involving the former Sanitation Minister, Cecilia Abena Dapaah, and seven others have brought about an interesting turn of events in the High Court in Accra. The State Prosecutors had initially sought to restrict two housemaids of the former minister and five others from disposing of properties allegedly purchased with stolen money. However, the Court, presided over by Justice Marie-Louise Simmons, has struck out the Prosecutors' request following their withdrawal of the application.



During the Court proceedings on Monday, March 24, 2024, State Prosecutors informed the Court of their decision to withdraw the application for restrictions on property disposal, after discussions with their superiors. Subsequently, Justice Simmons ruled that the application is struck out as withdrawn.


The legal proceedings continue with the Case Management Conference underway, and all accused persons present. Patience Botwe, Sarah Agyei, and five others have pleaded not guilty to a combined 31 counts. Despite being granted bail, they remain in lawful custody as they are yet to satisfy their bail terms.


Notably, the Prosecution had previously sought an order to restrict the disposal of properties allegedly purchased with stolen funds of the former sanitation minister. However, Justice Simmons pointed out that the grounds cited by the Prosecution under section 147 of the Criminal and Other Offenses Act, Act 30, were related to third parties in possession of properties, making it impossible for the court to consider the application in its current form.


The charges against the accused individuals include counts of conspiracy, stealing, dishonestly receiving, and money laundering. The case has seen a significant development with a charge sheet comprising 31 counts being filed at the High Court, which is eight more than the previous amended charge sheet.


It is evident that the legal proceedings surrounding this case continue to unfold with complexities and intricacies. As the Case Management Conference progresses, it is anticipated that further details will emerge, and the parties involved will conclude their proceedings on April 17, 2024.
