In a landmark case that underscores the importance of protecting the rights and dignity of children, the Bekwai Circuit Court has sentenced Ebenezer Birikwai, a 23-year-old mason, to 15 years in prison with hard labor for the heinous crime of defiling a four-year-old girl. The case, which has drawn significant public attention, highlights the judicial system's commitment to ensuring justice for vulnerable victims.
The Crime and Arrest
Ebenezer Birikwai, also known by his alias “Immortal,” was arrested on April 16, 2026, at Manso Afedie following an incident that shocked the local community. According to court records, the crime occurred at approximately 12:00 pm when the victim, a four-year-old girl, was playing with her friends in a corridor. Birikwai approached the group and distracted the older children by engaging them with games on his mobile phone. While the other children were occupied, he took advantage of the situation and sexually assaulted the young victim.
The assault was interrupted when the victim’s aunt happened to pass by and noticed a disturbing change in the child's facial expression. Acting swiftly, she pulled the child away from Birikwai and discovered him in a compromising state—partially undressed with his shorts pulled down and his manhood erect. Further examination revealed white fluid oozing from Birikwai's genitalia, with similar traces found on the victim’s thighs.
The aunt immediately raised an alarm, drawing a crowd that included the victim's mother. The situation escalated rapidly, but the timely intervention of the Unit Committee Chairman helped prevent mob action against Birikwai. The Manso Adubia police arrived shortly thereafter and arrested him. The case was then transferred to the Domestic Violence and Victim Support Unit (DOVVSU) for further investigation.
Medical Evidence and Legal Proceedings
A police medical report form was issued for the victim, who was examined by Dr. (Mrs.) Patience S. Marfo at St. Martin’s Catholic Hospital in Agroyesum. The medical examination confirmed the assault, revealing an “opened broken hymen.” This crucial evidence formed part of the case presented to the court.
During his first appearance before the Bekwai Circuit Court, Birikwai pleaded guilty to charges of defilement of a child under 16 years, contrary to section 101 of the Criminal Code 1960, Act 29, as amended by Act 554 Section 11. Detective Chief Inspector Eric Twum provided detailed accounts of the incident to the court presided over by His Honor Isaac Apeatu.
