Bissue vs OSP: New judge yet to be assigned, case adjourned to March 11

The case of Charles Bissue seeking the enforcement of his human rights in an action against the Office of the Special Prosecutor (OSP) has hit a temporary roadblock. The hearing, originally scheduled for February 21, 2024, has been adjourned to March 11, 2024. This delay is due to the fact that a new judge has yet to be assigned to the case docket following the retirement of Justice Nicholas Mensah Abodakpi, who was previously presiding over the case at the Human Rights Court 2.






In a recent court session on Wednesday, February 21, Justice Barbara Tetteh-Charway, the presiding Judge at the Human Rights Court 1, sat as a relieving judge. However, the case was adjourned prior to her sitting.


The suit was initially scheduled for hearing on February 1, 2024, but the Court did not sit, leading to an adjournment to Wednesday, February 21. Meanwhile, the Written Submission on behalf of the Applicant (Charles Bissue) was filed on January 31, 2024. The OSP’s Written Submission has also been served on Lawyers of the Applicant led by Nana Agyei Baffour-Awuah on February 1, 2024.


Charles Bissue, the former Secretary to the Inter-Ministerial Committee on Illegal Mining, is seeking several reliefs from the Human Rights Court. These include the quashing or cancellation of the Arrest Warrant issued against him by the OSP, as well as compelling the OSP to comply with specific provisions by providing him with a copy of the Petitions forming the basis of the investigations being conducted.


Furthermore, Charles Bissue is seeking to prohibit the OSP from applying for Arrest Warrants and hounding him in the name of investigations pending the determination of Suit No. J/0328/2023.


As this case unfolds, it is clear that there are significant legal intricacies at play. The adjournment to March 11, 2024, signifies a delay in the pursuit of justice for Charles Bissue. It remains to be seen how the appointment of a new judge will impact the proceedings and ultimately, the outcome of this case.
