Businessman jailed four years for appropriating late brother’s entitlement

In a recent legal case that has garnered public attention, Kwame Tengey, a businessman, found himself at the center of a court trial that ultimately led to a four-year imprisonment sentence. The Accra Circuit Court, presided over by Mrs. Evelyn Asamoah, found Tengey guilty of fraudulent breach of trust, a serious offense that carries significant legal consequences.



The case revolved around Tengey's actions following the death of his brother, Inspector Patrick Tengey, who was a member of the Ghana Police Service. Kwame Tengey, assuming the role of family head, undertook the responsibility of collecting his late brother’s entitlement from the Ghana Police Service, which amounted to GHC206,212.65. However, instead of fulfilling his duty to distribute the funds to his late brother’s three children in accordance with the disbursement form, Tengey chose to act in a manner that was deemed dishonest and unlawful.


Despite being entrusted with the task of collecting and distributing his late brother’s entitlement, Tengey failed to uphold his responsibilities. He received two cheques totaling GHC206,737.55 and GHC98,737.55, yet neglected to share the funds as stipulated. Instead, he attempted to deceive the beneficiaries by offering them only a fraction of what they were rightfully entitled to, without disclosing the total amount involved.


Following a trial where Tengey pleaded not guilty, the court reached a verdict that resulted in a four-year prison sentence for the convicted businessman. Additionally, the court ordered the Administrator General to ensure the remaining funds are distributed among the children and other beneficiaries. Furthermore, a vehicle impounded by the police during the trial is set to be sold, with the proceeds directed towards the children.


The prosecution, led by Assistant Superintendent of Police (ASP) Emmanuel Haligah, emphasized Tengey's lack of remorse throughout the trial and urged the court to impose a custodial sentence as a deterrent to others who might contemplate similar actions.
