‘You know next to nothing about NAM 1’s case’ – Kwame Akuffo tells Investigator

In a recent development in the criminal case against Nana Appiah Mensah, the CEO of defunct Menzgold Ghana Limited, his lawyer, Kwame Akuffo, has raised serious concerns about the lead investigator's understanding of the case.



During the cross-examination, Kwame Akuffo accused the investigator, DSP Charles Nyarko, of being uninformed about the facts of the case based on his responses to questions under oath. The crux of the matter revolves around Nana Appiah Mensah's alleged engagement in deposit-taking activities contrary to directives from the Bank of Ghana.


The investigator claimed that communications from the Bank of Ghana to Nana Appiah Mensah and Menzgold Ghana Limited indicated a warning against engaging in deposit-taking ventures without a license. Furthermore, it was alleged that Nana Appiah Mensah formed Brew Marketing Company to bypass these directives and continue with deposit-taking activities.


However, during cross-examination, Kwame Akuffo challenged the investigator's interpretation of the communications from the Bank of Ghana, suggesting that they did not necessarily imply deposit-taking activities. The investigator disagreed, citing the company's operational history from 2013 to 2018 as evidence of such activities.


Additionally, Kwame Akuffo questioned the absence of evidence that the investigating team had taken a statement from an official of the Bank of Ghana. While the witness confirmed this, he explained that a response from the Bank of Ghana to a request from the CID reflected the central bank's position on the matter. Despite this explanation, no document on record was presented to support this correspondence.


In a bold assertion, Kwame Akuffo suggested that the lack of evidence regarding this correspondence was indicative of the investigator's limited understanding of the case. However, DSP Charles Nyarko maintained that he has been deeply involved in the matter since the initial complaints surfaced in November 2018.


As the case adjourns to Tuesday, it is evident that the legal battle surrounding Nana Appiah Mensah's alleged involvement in deposit-taking activities continues to unfold. The outcome of this legal tussle will undoubtedly have far-reaching implications for all parties involved.
